    Overall, I agree that the state banning private vaccine mandates is a bad idea, but the alternative of the state offering to shield the private company from Federal enforcement is unfortunately complicated. The biggest employers are likely to be large global corporations, who may face discrimination at the hands of every other jurisdiction in the world where they operate if management takes a stand for medical freedom instead of The Science. It’s an ironic situation where they might actually prefer to have medical freedom imposed upon them by a jurisdiction so that they can shrug their shoulders before their global interests and say “What can we do? We’re just following the law in that state.”

    Additionally, because they operate in so many different places, it’s possible that, for stream-lining purposes, their legal / compliance / technical infrastructure is built around complying with the most stringent policies of all the jurisdictions where they operate (kind of like how the auto manufacturers design according to California’s standards because if a vehicle model complies with California standards, it complies everywhere else in the US.) So even if they have the option to not comply in one jurisdiction, they may decide it’s cheaper and tidier to maintain the same health guidelines across the organization, and not exempt the one jurisdiction.

    Lastly, it’s not clear how the state would go about interposing itself. The Federal government would surely be assessing fines electronically, and if the company resisted, the Federal government would probably just help themselves to the company’s bank account electronically. Even if some kind of physical raid were to occur, it would probably happen at the organization’s global headquarters, which could be in an altogether different state.
